We might not know what it is, or how it works, but it is almost guaranteed we will encounter it in some form across our lives \u2013 be it day-to-day through unlocking our phones, or occasionally through airport customs. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But what about the technology we are less aware of? \u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The unthinkable happened to Robert Williams in 2020 when he was arrested for a crime he had not committed. Detroit officers arrested him in front of his children based on a tip that showed him as the closest match to the perpetrator they had caught on CCTV. <a href=\"https:\/\/www.technologyreview.com\/2021\/04\/14\/1022676\/robert-williams-facial-recognition-lawsuit-aclu-detroit-police\/\" target=\"_blank\" rel=\"noreferrer noopener\">At his questioning, he asked the officers, \u2018I hope y\u2019all don\u2019t think all black people look alike,\u2019 to which they said, \u2018the computer says it\u2019s you.\u2019<\/a> \u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This traumatic experience that Williams endured was due to the usage of AI FRT, which had access to driver&#8217;s licenses in Michigan \u2013 crucially, without the permission of the owners. <a href=\"https:\/\/amp.theguardian.com\/technology\/audio\/2024\/mar\/18\/episode-5-the-white-mask\" target=\"_blank\" rel=\"noreferrer noopener\">Joy Buolamwini predicted these types of false arrests would occur back in 2016<\/a> \u2013 as a computer scientist, Joy looked at how FRT recognised different types of faces during her master&#8217;s degree. From this, she made the assertion that FRT was <a href=\"https:\/\/amp.theguardian.com\/technology\/audio\/2024\/mar\/18\/episode-5-the-white-mask\" target=\"_blank\" rel=\"noreferrer noopener\">32 times more likely to make a mistake identifying the face of a black woman than a white man.<\/a> \u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Errors such as this occur due to the data the AI trains on being biased. This, with reference to the case of Robert Williams, is alarming considering that police in the United States are using\u202fit to catch criminals. \u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perhaps more alarmingly, similar FRT is in use in the United Kingdom\u2019s police force; Retrospective Facial Recognition (RFR) is confirmed to be in use by: <a href=\"http:\/\/bigbrotherwatch.org.uk\/wp-content\/uploads\/2023\/05\/Biometric-Britain.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">South Wales Police, Gwent Police, Cheshire Constabulary, and the Metropolitan Police Service as of 2023.<\/a> <a href=\"https:\/\/plus.lexis.com\/uk\/document\/?pdmfid=1001073&amp;crid=4b22eaad-4ede-4ace-8247-c521c3e80a5a&amp;pddocfullpath=%2Fshared%2Fdocument%2Fanalytical-materials-uk%2Furn:contentItem:6CB4-DNH3-RRTY-W05S-00000-00&amp;pdcontentcomponentid=420531&amp;pdteaserkey=&amp;pdislpamode=false&amp;pddocumentnumber=2&amp;pdworkfolderlocatorid=NOT_SAVED_IN_WORKFOLDER&amp;ecomp=5t5k&amp;earg=sr1&amp;prid=fcafe5c7-6610-4b14-877e-67f78531f3de&amp;federationidp=G9JC5W59630&amp;cbc=0\" target=\"_blank\" rel=\"noreferrer noopener\">RFR allows police to look back in time to determine who was at a particular location, at a particular time, severely limiting individuals&#8217; ability to live their day-to-day lives anonymously.<\/a>\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The case of <a href=\"https:\/\/www.judiciary.uk\/wp-content\/uploads\/2022\/07\/R-Bridges-v-CC-South-Wales-ors-Order-2.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">R (Bridges) v Chief Constable of South Wales Police [2020] EWCA Civ 105<\/a> demonstrates how this use of FRT\u202fcan be found to be in breach of our human rights. Here, the claimant <a href=\"https:\/\/www.simmons-simmons.com\/en\/publications\/ckelg1z7p8kjt09008l0bet7c\/uk-court-of-appeal-finds-facial-recognition-technology-unlawful\" target=\"_blank\" rel=\"noreferrer noopener\">brought judicial review proceedings against South Wales Police after they launched a surveillance project using FRT, which was deployed at certain locations where crime was likely to occur, capturing up to 50 faces per second of members of the public. It has been estimated that over the 50 deployments that were undertaken in 2017 and 2018, the technology may have captured sensitive facial biometric data from around 500,000 people, without their consent.<\/a>\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On the face of this, it is apparent that there are issues with the deployment of this technology; notably in respect of human rights violations. <a href=\"https:\/\/www.simmons-simmons.com\/en\/publications\/ckelg1z7p8kjt09008l0bet7c\/uk-court-of-appeal-finds-facial-recognition-technology-unlawful\" target=\"_blank\" rel=\"noreferrer noopener\">The Court of Appeal laid down in their judgement that the deployment of this technology was in breach of Article 8 of the ECHR (the right to respect for our private and family lives), and that the police were silent as to the risks to other rights which are likely to be affected by its use, namely the rights to freedom of assembly under Article 11 of the ECHR and freedom of expression under Article 10 of the ECHR.<\/a>\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This judgment is significant for several reasons; alongside the court naming the human rights violations that can come with deploying this technology, they also list the rights that <em>could <\/em>be violated, illustrating the court&#8217;s proactivity and anticipation of other issues. The effect of this pervasive surveillance has <a href=\"https:\/\/academic.oup.com\/jhrp\/article\/16\/1\/397\/7234270?login=false\" target=\"_blank\" rel=\"noreferrer noopener\">profound consequences to an individual\u2019s human rights, most notably in respect to the development of their identity and their political participation.<\/a>\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/academic.oup.com\/jhrp\/article\/16\/1\/397\/7234270?login=false\" target=\"_blank\" rel=\"noreferrer noopener\">This consequence is known as a chilling effect, which is where individuals modify their behaviour due to the fear of surveillance. This can influence a range of issues, such as what websites a person visits, what organisations they join, or whether they partake in political activities<\/a>.All of which are worrying restrictions of freedom.\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This usage of Facial Recognition Technology marks a\u202fchange in police surveillance\u202fthat may <a href=\"https:\/\/plus.lexis.com\/uk\/document\/?pdmfid=1001073&amp;crid=4b22eaad-4ede-4ace-8247-c521c3e80a5a&amp;pddocfullpath=%2Fshared%2Fdocument%2Fanalytical-materials-uk%2Furn:contentItem:6CB4-DNH3-RRTY-W05S-00000-00&amp;pdcontentcomponentid=420531&amp;pdteaserkey=&amp;pdislpamode=false&amp;pddocumentnumber=2&amp;pdworkfolderlocatorid=NOT_SAVED_IN_WORKFOLDER&amp;ecomp=5t5k&amp;earg=sr1&amp;prid=fcafe5c7-6610-4b14-877e-67f78531f3de&amp;federationidp=G9JC5W59630&amp;cbc=0\" target=\"_blank\" rel=\"noreferrer noopener\">fundamentally alter the balance of power between the state and its citizens.<\/a> The changing nature of AI\u202fis sure to be a central subject of legal development in the coming years \u2013 and where it will lead the law next is certain to be a captivating evolution.\u202f\u00a0<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n        <div
